These Terms & Conditions ("Terms") govern your access to and use of the Dental MS platform, website, and services (the "Service") provided by Kawsar Dental. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of terms

By registering a clinic account or otherwise using Dental MS, you confirm that you have read, understood, and agree to these Terms and any policies referenced in them. If you accept these Terms on behalf of a clinic, you represent that you have the authority to bind that clinic.

2. The Service

Dental MS is a cloud-based practice management platform that helps dental clinics manage appointments, patient records, prescriptions, inventory, billing, and related workflows. We may update, add, or remove features at any time, and may suspend or discontinue the Service (in whole or in part) with reasonable notice.

3. Your account and responsibilities

You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information at signup, keep your clinic and team details current, and ensure each team member uses their own credentials with the appropriate role. You are responsible for your team's use of the Service.

4. Subscriptions, billing, and refunds

Paid plans are billed in advance via our supported payment provider (bKash). Subscription fees are non-refundable except where required by law. Renewing or upgrading extends your access period; downgrades or cancellations take effect at the end of the current paid term. Applicable taxes are stated on your invoice.

5. Acceptable use

You agree not to misuse the Service — including by uploading unlawful or infringing content, attempting to access data you are not authorized to access, interfering with the Service's security or operation, reverse-engineering the platform, or using the Service to send spam. We may suspend access for conduct we reasonably believe violates these Terms.

6. Patient data and privacy

You retain all rights to the patient and clinic data you enter. You are responsible for obtaining any consent needed to store and process patient information and for complying with applicable privacy laws. We process data as your service provider and protect it with encryption, role-based access, and audit logging. Our handling of personal data is described in our Privacy Policy.

7. Intellectual property

Dental MS, its software, branding, and content are owned by us and our licensors and are protected by intellectual property laws. These Terms grant you a limited, revocable, non-exclusive licence to use the Service for the duration of your subscription, solely to run your clinic. You may not copy, resell, or redistribute the platform.

8. Disclaimers and limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for any loss of data, revenue, or profits arising from your use of the Service. Our total liability for any claim is limited to the fees you paid in the three months before the claim.

9. Suspension and termination

You may stop using the Service and cancel your account at any time. We may suspend or terminate your access if you breach these Terms, if your account remains unpaid, or to protect the Service. On termination, your right to use the Service ends; where available, you may export your data before termination.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continuing to use the Service after a change takes effect means you accept the updated Terms.
